Terms and conditions
The present "General Terms and Conditions of Sale" apply to legal transactions relating to products marketed to its customers by MORS AND MORE within its online store.
The following words or expressions shall have the following meanings:
Internet Store: means the MORS AND MORE website on which the Products are displayed and sold to customers.
Order: means the contract of sale between MORS AND MORE and the customer of the MORS AND MORE Internet Shop.
Product sheet: means the classified information concerning a product provided by MORS AND MORE when the product is put on sale in its internet shop.
Products: means all the goods and services offered for sale by MORS AND MORE in its internet shop.
Service: means the sale of Products by MORS AND MORE to the customers of its internet shop.
Transaction: means all transactions, secure processing, authorizations and agreements relating to the payment of the price of products ordered by credit card.
ARTICLE 1: OBJECT
These General Terms and Conditions of Sale are intended to define the terms and conditions to which MORS AND MORE offers and sells its Products to its customers.
These general conditions of sale will prevail over all other conditions appearing in any other document, except preliminary, express and written exemption.
ARTICLE 2 - ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing an Order, these terms and conditions of sale and expressly accept them without reservation.
The present general conditions of sale govern the contractual relations between MORS AND MORE and its customer, the two parts accepting them without reserve.
ARTICLE 3 - PRODUCTS
The majority of products offered by MORS AND MORE to its customers are immediately available.
However, all products marketed by MORS AND MORE may or may not be sold online.
ARTICLE 4 - ORDER
Automatic registration systems are considered to be proof of the nature, content and date of the Order.
MORS AND MORE will confirm to the customer the acceptance of his Order by sending a confirmation message to the email address that he has communicated. The sale will not be concluded until the sending of the order confirmation.
MORS AND MORE reserves the right to refuse or cancel any Order from a customer, particularly in the event of insolvency of said customer or in the event of a failure to pay the Order in question or a previous delivery or a dispute over the payment of a previous order.
The particulars indicated by the customer, when entering information pertaining to his Order, bind him. MORS AND MORE can not be held responsible for errors committed by the customer in the wording of the addressee of the Order (delivery address, billing address in particular) and delays in delivery or the inability to deliver the ordered Products that these errors could engender.
ARTICLE 5 - DELIVERY
After confirmation of the Order and subject to payment of the price of the products ordered, MORS AND MORE undertakes to send to its customer the products ordered at the delivery address within 5 days.
All the Products stipulated in the Orders placed with MORS AND MORE are intended for the personal use of the customers or the recipients whose name is mentioned at the address of delivery.
In this case, the customer agrees to settle upon receipt, all taxes, duties, taxes and other charges present and future due for the delivery of said products themselves; the joint and several liability of MORS AND MORE can not at any time be engaged in this respect.
The customers or the recipients of the Products are prohibited any partial or total resale of the Products.
The delivery will be made by La Poste colissimo followed or chronopost according to your request.

In case of late delivery exceeding seven (7) days, the Customer may, if he wishes, and except in case of force majeure, denounce the sales contract by registered letter with acknowledgment of receipt. This right must, however, be exercised within sixty (60) working days from the date of delivery initially provided for in the contract.
In the event that one or more of the Products ordered are missing or damaged, the customer or the recipient must make any reservations with the carrier at the time of delivery.
In case of apparent defects, the customer has the right of return under the conditions provided in the instructions for use of the property.
For reasons of availability of the Products ordered, an Order may be the subject of several successive deliveries to the customer.
In the event that the customer would like the Products ordered to be delivered to two different addresses, it will be necessary for the latter to pass 2 separate Orders.
ARTICLE 6 - RETRACTION
The customer has a period of 7 days from receipt of the Products ordered to return them to MORS AND MORE for exchange or refund. In this case, the customer will have to return the new, intact Products, accompanied by all the possible accessories, instructions of use and documentations to the following address:

In case of exercise of the right of retraction, MORS AND MORE undertakes to refund the sums paid by the customer, without expenses, with the exception of the expenses of return.
The refund is due within a maximum of 14 days.
ARTICLE 7 - PRICES
The price is expressed in euro.
The price indicated on the Product Sheets does not include the costs inherent to the transport.
The price indicated in the order confirmation is the definitive price, all taxes included and including VAT. This price includes the price of the Products, the costs of handling, packaging and storage of the Products, transport costs and commissioning.
ARTICLE 8 - PAYMENT
The price charged to the customer is the price indicated on the order confirmation sent by MORS AND MORE.
The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the actual order.
The Order validated by the customer will only be considered effective when the secure bank payment center has given its agreement on the transaction and, if applicable, after acceptance of the assumption of risk by the insurer.

ARTICLE 9 - APPLICABLE LAW
These general conditions of sale are subject to French law.
ARTICLE 10 - LIABILITY
MORS AND MORE can not be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the Products marketed.
The responsibility of MORS AND MORE will, in any case, be limited to the amount of the order. In case of difficulties in the application of this contract, the customer and MORS AND MORE reserve the possibility, before any action in court, to seek an amicable solution.
Otherwise, for business customers, the Commercial Court of Calais is the only competent, whatever the place of delivery and the method of payment accepted.
ARTICLE 11 - GUARANTEE
In any case MORS AND MORE can not be held responsible for non-compliance with the regulations and laws in force in the country of reception. The liability of MORS AND MORE is systematically limited to the value of the Product in question determined at the date of its sale and this without recourse to the brand or the company producing the product.

ARTICLES 12 - LEGAL INFORMATION
The information of the personal information collected for the purposes of the distance selling is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The lack of information leads to the non-validation of the Order.
In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale Informatique et Libertés (CNIL).
The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of the data which concern him, which he can exert near Store-Factory. In addition, Mors and more undertakes not to communicate, free of charge or in return, the details of its customers to a third party.
ARTICLE 13 - MORS RENTAL SERVICE
13.1 Selection of a bit
The bits are rented new bits bought. Mors and More provides maintenance and renovation of the jaws before each rental.
Mors and more may at any time and freely remove and / or add bits as part of the rental service.
13.2 Rental formulas
For a majority of the jaws, the rental is for a period of 10 days (week end and holidays included).
The Customer may request to renew its rental, for successive periods of a duration identical to the initially chosen formula, upon request made to Mors and more, by email to the following address: firstname.lastname@example.org, before the fifth day preceding the return date of the rented jaw. Mors and more reserves the right to accept or refuse any renewal request made by the Client.
The customer has 5 days to pay his deposit. If beyond 15 days (5 days waiting for payment + 10 days rental) we do not have the deposit. The payment of the rent will be cashed and the bit will not be delivered.
13.3 Rental rates
The rates in effect for each rental form and for each jaw are available on the website www.morsandmore.com
Mors and more reserves the right to modify its rates at any time. However any change of rate applicable to the rental formula chosen by the Customer will be applied to it only at the end of the current rental period, that is to say at the time of renewal if it has been expressly authorized by Mors and more.
The payment of the rent intervenes on the day of the order and is carried out by credit card. In case of renewal, the Customer authorizes Mors and more to charge the rental price by debiting his credit card.
Any renting started is due for price of the entirety of its duration initially envisaged and will not give right to any refunding or compensation in the case for example of an advance stop of the hiring.
13.4 Placing an order
The Customer may rent several jaws simultaneously.
Mors and more will send the customer an order confirmation email indicating:
- the date of deposit of the parcel with the carrier;
- the number of the package (to allow follow-up on the Internet);
- the imperative return date of the bit;
- the state of the bit.
13.5 Shipping - Delivery
The delivery will be made by the provider selected by Mors and more for this purpose, to the address specified by the Customer in the subscription form or any other address indicated by the latter at the time of the order.
The delivery package includes:
- The bit in a soft protective case;
If the Client finds that the actual state of the bit does not correspond to the indications given by Mors and more in the order confirmation mail, he must:
- notify Mors and more by e-mail to the following address: email@example.com or by phone at 0668017651 and this, within one hour of delivery of the package and,
- return the bit within 24 hours. If postal services are closed, the Customer will return the bag no later than the first day of opening of a postal service.
Failing this, any appeal will be foreclosed, the Customer will no longer be able to dispute the information provided in the order confirmation mail and will not be entitled to any refund or compensation.
13.6 Calculation of the rental period
The first day of the rental begins on the day of delivery of the parcel by Morsandmore to its carrier provider as specified in the order confirmation letter referred to in Article 13.4. The deposit receipt communicated to Morsandmore by the service provider will prevail between the parties.
The last day of rental is the day of delivery of the bit, by the Customer, to the provider providing the return.
The rental period is calculated in calendar days. If the last day is a day during which the postal services are closed, it ends on the first day of the opening of a postal service.
The Customer must keep the receipt of the delivery provider as proof of deposit.
13.7 Back of the bit
The Customer will return the bit at the end of the rental period.
The Customer agrees to post the bit exclusively in its pre-paid initial packaging. The customer must ensure that the carrier gives him all evidence of deposit of the bit, otherwise it could be liable in case of disappearance of the product.
The Customer must also ensure the return transport in conditions at least equivalent to those proposed by Mors and more. In the absence of insurance, the loss, theft or damage of the bag during transport will give rise to compensation, on the part of the Customer, under the conditions referred to in Article 13.10.
Any exceeding of the rental period of more than 5 days will result in the cashing of the deposit check. Mors and more will consider that the bit suits you and you want to buy it.
13.9 Use of jaws during rental
The Customer agrees to use the bit with care and to take all necessary precautions to avoid damaging it. He assumes the material and legal custody under his full responsibility.
In particular, he undertakes to use for transport and storage, the protective pouch delivered for this purpose.
He will avoid:
- leave the bit for several hours in the water.
- to leave lying on the floor.
The Customer may use the bit only for its strictly personal use. Thus, it is prohibited to lend and sublet, to make available to a third party even for free and make any professional or commercial use.
13.10 Loss, theft or degradation of the bit
In the event of loss, theft, or degradation of the bit (stain, snag, bite mark, etc.), the Customer agrees to notify Mors and more by e-mail (send to: firstname.lastname@example.org) or by telephone ( 0620152027), and report them to the police station within 24 hours of the occurrence of the event.
Moreover, in case of degradation of the bit, the Customer is prohibited from proceeding or have repairs carried out by his own means. He will have to restore the bit within 24 hours. If the postal services are closed, the first day of opening a post office.
Any return of a jaw in a condition other than that indicated in the confirmation mail referred to in Article 13.4 shall be understood as a degradation.
Mors and more reserves the right to charge the Customer:
- in case of deterioration, the price of the repair upon presentation of the invoice or if the repair can not return the bit to its original state, the price of a bit of substitution;
- in case of loss or theft, the price of a bit of substitution.
The price of a substitute jaw is defined as follows:
- The price of a replacement jaw is the purchase price by Mors and More of a replacement jaw, identical to the previous one;
Mors and More will provide a copy of the invoice as proof.
The Client agrees that Mors and more can recover directly the full price of substitution by direct debit or cashing of the deposit check and is expressly prohibited from taking any measure likely to prevent recovery.
Mors and More undertakes to rent only bits that are not counterfeits.
Any returned bit that turns out not to be the rented jaw will be treated by Mors and More as a case of loss or theft. If, the bit thus returned, proved to be a counterfeit, Mors and More reserves any recourse against the Customer.
